Terms and Conditions
SAFETY UNLIMITED , INC. RESERVES THE
RIGHT
TO REFUSE SERVICE TO ANYONE.
DEFINITIONS:
"Agreement" means all terms and conditions found on both sides of this form,
any addenda and any additional materials we provide at the time of rental.
"You" or "your" means the person identified as the renter on the reverse,
any person signing this Agreement, any Authorized Driver and any person or
organization to whom charges are billed by us at its or the renter's
direction. All persons referred to as "you" or "your" are jointly and
severally bound by this Agreement. "We,” "our" or "us" means the rental
company named on the reverse. "Authorized Driver" means you, provided you
are at least age 25, any additional driver approved by us and listed by us
on this Agreement, provided that person is licensed and at least age 25,
your spouse if licensed and at least age 25, your employer and co-worker, if
engaged in business activity with you while using the Vehicle, provided that
person has a valid driver's license and is at least 25 years of age.
"Vehicle" means the recreational vehicle, motor home, truck camper or camper
trailer identified in this Agreement and any substitute, and its tires,
tools, accessories, equipment, appliances, keys and vehicle documents.
“MBA Choice” means a separate vehicle liability, collision and comprehensive
insurance policy you may purchase.
RENTER AND DRIVER REQUIREMENTS:
Qualified renters and drivers must be 25 years of age or older and
possess a valid and identifiable driver's license. In addition, a major
credit card, employment verification, references, or a foreign passport are
required as identification prior to rental and will be verified. Additional
drivers are allowed but must present their own proof of insurance as per the
insurance requirements. An
additional $25.00 fee applies for each additional driver. All drivers must
be listed on and sign the RV Rental Agreement and will be bound by Terms and
Conditions of the RV Rental Agreement. All drivers must be present at
vehicle pickup.
RESERVATIONS:
Reservations can be initiated by filling out the
Reservation Application, or
by telephone. Reservations are not confirmed until a $500.00 prepayment fee
has been collected. The required prepayment can be made either by check or
credit card (Visa, MasterCard, American Express, and Discover are accepted
cards). Cash is not accepted for the prepayment. After approval of the
Reservation Application the
RV will be reserved for the dates specified until such time that Rental
Agreement is completed and full payment (see payment requirements below) is
made. Reservation Applications are processed on a first-come, first-served
basis with the dates tentatively reserved. No same day rentals allowed. A
minimum of 48 hours is required to process all necessary paperwork and
approve the Reservation Application.
LIABILITY INSURANCE:
You are responsible for all damage or loss you cause to others. You
must provided us with an insurance binder indicating that you have vehicle
liability, collision and comprehensive insurance covering you, us, and the
Vehicle. Since you have auto liability insurance either purchase through us,
or supplied on your own, we provide no liability insurance.
MBA CHOICE:
If you do not provide us with an insurance binder but elected to
purchase MBA Choice, the following changes apply to this agreement:

Damage” means any collision or comprehensive loss to, or
of, the Vehicle; collision or comprehensive losses do not include damage
to the interior of the Vehicle or its appliances; |

Damage to the Vehicle is covered by MBA Choice. The
policy has a deductible, per occurrence. |

Auto liability insurance is part of MBA Choice, and
provides coverage for bodily injury and property damage with limits no
higher than the minimum levels prescribed by the vehicular financial
responsibility laws of the state where the damage or loss occurs. MBA
Choice covers $2,000 medical payments or personal injury protection, and
statutory limits of uninsured and under insured motorist coverage.
Coverage applies in the United States, its territories and possessions,
and Canada. Coverage is void if you violate the terms of this Agreement or
if you fail to cooperate in any loss investigation conducted by us, or the
insurer. Allowing an unauthorized driver to operate the Vehicle
terminates our liability insurance coverage. |
VEHICLE PICK-UP AND DEPARTURE:
Pick-up and departure time is between 1:00 PM and 4:00 PM and
made by appointment only. Please call in advance as the vehicle is not
guaranteed to be ready at 1:00 PM on all occasions. Early pick-up and
departure can be arranged on some occasions, but is not guaranteed
as the vehicle may be returning earlier that same day from another
customer. Vehicle pick-up and departure will be done in Simi
Valley, California unless otherwise pre-arranged. Vehicle delivery to
another location may be set up on a case-by-case basis for a nominal fee.
Please allow for a minimum of one hour for vehicle orientation and
paperwork.
VEHICLE DROP-OFF AND RETURN:
Vehicle drop-off and return time is between 8:00 AM and 11:00
AM on the agreed upon return date. Extensions may be granted on a
case-by-case basis, but only with approval from Safety Unlimited, Inc. by
calling in advance. A late fee of $50.00 per hour will apply when the
vehicle is not returned by 11:00 AM. Vehicle drop-off and return
will be done in Simi Valley, California unless otherwise pre-arranged.
Vehicle drop-off and return at other locations may be arranged on
a case-by-case basis for a nominal fee. There are no refunds for early
drop-off and returns.
PAYMENTS:
Full rental payment including any applicable taxes, is due upon
return of Rental Agreement, and is considered overdue within 30 days of
pick-up and departure date. Reservations made within 30 days of pick-up and
departure date require immediate payment. If full payment is not made
timely, reservation dates will not be held. The deposit is due at the time
of pick-up and departure. Payment must be made by credit card. Credit
cards used for payments must match the name of Renter, and must be made
available for imprint at vehicle pick-up and departure. Use
of more than one credit card is acceptable.
DEPOSIT:
A security deposit of up to $1,500.00 will be required for most
rentals depending on the length of rental agreement. The deposit is due at
pick-up and departure times. Acceptable forms of payment for
the security deposit are cash or cashiers check. Credit cards are not
accepted for this payment. An additional security deposit may be required
depending on the circumstances of the rental agreement. Security deposits
will be returned via check 7 to 10 days after vehicle drop-off and
return less any costs, such as but not limited to, additional
mileage fees, additional generator use fees, cleaning fees, fueling costs,
dump charges, propane costs, damage and down-time costs, or parking
violations. It is our intention to process deposit returns immediately.
CANCELLATION POLICY:
There is no fee for reservation rescheduling based upon RV
availability. Reservations cancelled over 21 days prior to pick-up
and departure, are subject to $100.00 cancellation fee.
Reservations cancelled between 11 and 20 days prior to pick-up and
departure, are subject to a $500.00 cancellation fee. Reservations
cancelled within 10 days of departure day are subject to full rental fee.
CHARGES:
You agree to pay us, or the appropriate government authorities, on
demand for all charges due us under this Agreement, including, but not
limited to: (a) time and mileage for the period during which you keep the
Vehicle, or a mileage charged based on our experience if the odometer or
its seal is tampered with or disconnected; (b) charges for additional
drivers; (c) charges for the optional products and services you elected to
purchase; (d) fuel, if you return the Vehicle with less fuel than when
rented; (e) applicable taxes; (f) loss of, or damage to, the Vehicle, which
includes the cost of repair, or the actual cash retail value of the Vehicle
based on valuation methods accepted by the auto insurance industry on the
date of the loss if the Vehicle is not repairable, or if we elect not to
repair the Vehicle, plus our administrative expenses incurred processing the
claim, all in accordance with Cal. Civil Code section 1936; (g) all fines,
penalties, forfeitures, court costs, towing and storage charges and other
expenses involving the Vehicle assessed against us or the vehicle, unless
these expenses are our fault; (h) actual expenses we incur in locating and
recovering the Vehicle if you fail to return it or if we elect to repossess
the Vehicle under the terms of this Agreement; (i) all costs, including pre-
and post-judgment attorney fees, we incur collecting payment from you or
otherwise enforcing our rights under this Agreement; (j) $25 or the
maximum amount permitted by law, whichever is greater, if you pay us with a
check returned unpaid for any reason.
CLEANING FEE:
Cleaning fee of $75.00 for normal cleaning will be
assessed. Special cleaning required, such as for odor fumigation, stains
and undercarriage washing done at the sole discretion of Safety Unlimited,
Inc., and will be deducted from original deposit.
RENTAL, INDEMNITY AND WARRANTIES:
This Agreement is a contract for the rental of the Vehicle. We may
repossess the Vehicle at your expense without notice to you, if the Vehicle
is abandoned or used in violation of law or this Agreement. You agree to
indemnify us, defend us and hold us harmless from all claims, liability,
costs and attorney fees incurred by us resulting from, or arising out of,
this rental and your use of the Vehicle. We make no warranties, express,
implied or apparent, regarding the vehicle, no warranty of merchantability
and no warranty that the vehicle is fit for a particular purpose.
GASOLINE:
The RV fuel tank will be full when delivered to Renter. Renter is
fully responsible for fueling as needed. Renter is also responsible for
returning the RV with the fuel tank full with the appropriate octane
gasoline. A $25.00 fill charge, plus the price of gasoline will be deducted
from the deposit if the RV is not returned with a full tank of fuel. No
warranties are made as to fuel mileage or consumption.
HOLDING TANKS:
Holding tanks must be dumped and empty upon return, or Safety
Unlimited, Inc. will dump both holding tanks for $45.00. All appropriate
hoses will be provided.
PROPANE:
The propane tanks will be full at pick-up and departure
and renter is responsible to return RV with propane tank topped off. A
$25.00 fill charge, plus the price of propane will be deducted from the
deposit if the RV is not returned with a full tank of propane.
TOWING:
Towing is not allowed.
ROOF ACCESS:
Access onto the roof of the RV is not allowed. Storage on the roof
is also not allowed.
AWNING USE:
The awning may be used during the rental period. Be advised that
damage to the awning is the most damaged component on the RV. Renter is
completely financially responsible to any damage that occurs to the awning.
MBA insurance will not cover any awning damage. Also be advised that the
awning may not always be in working and is not guaranteed as part of the
standard rental price. No refund will be issued if the awning does not
work.
MAINTENANCE:
The customer is responsible for checking engine oil and coolant levels at
each refueling as well as reporting mechanical failures immediately.
Coolant refills and authorized repairs will be reimbursed upon return of the
vehicle and presentation of all receipts (see Mechanical Breakdown). It is
the driver's responsibility to operate the vehicle in a safe manner and to
exercise all caution possible.
ROADSIDE ASSISTANCE:
24-Hour roadside assistance is offered, and included in rental price.
MECHANICAL BREAKDOWN/REPAIRS:
Customers may be held responsible for mechanical damage due to negligence in
vehicle operation or failure to provide normal maintenance. In the event
the vehicle is in breakdown repair for 12 hours or more, through no fault of
the customer, our responsibility to the customer is limited to refund of
daily rate or portion thereof. Customers are required to cooperate fully
with Safety Unlimited, Inc. to remedy any problem. For repairs exceeding
$50.00 the customer must call Safety Unlimited, Inc. to obtain proper
authorization. Non-authorized repairs exceeding $50.00 will not be
reimbursed. Receipts must be presented to Safety Unlimited, Inc for
reimbursement.
Defects on Radio/CD/Tape/TV/VCR/, Air Conditioning, Refrigerator, Generator,
Awning, Slide-out and Cruise Control are not considered a technical defect
on the vehicle and there is no refund.
RESPONSIBILITY FOR DAMAGE OR LOSS; REPORTING TO POLICE:
You are responsible for all damage to the Vehicle, missing
equipment, and our administrative expenses connected with any damage claim
in accordance with California Civil Code § 1936, regardless of whether or
not you are at fault. You are responsible for loss due to theft of the
vehicle and all damage due to vandalism that occurs in connection with a
theft, if you fail to exercise ordinary care while in possession of the
Vehicle. You are responsible for damage due to vandalism not associated
with theft of the Vehicle up to a maximum of $500. You must report all
accidents or incidents of theft and vandalism to the police as soon as you
discover them. You must report all accidents involving the Vehicle to
Safety Unlimited, Inc. within 24 hours of occurrence.
INCIDENTAL DAMAGE:
There are risks with traveling which includes broken windshields,
flat tires and awning damage. The renter bears all financial responsibility
for damage to these items during rental period.
IN THE EVENT OF AN ACCIDENT:

The renter must obtain a local police report as provided by the attending
police officer investigating the accident. An accident report form is
supplied to the customer and is located in the vehicle along with the
registration and insurance papers. |

Safety Unlimited, Inc. must be notified as soon as possible. A
full-written report along with all party's involved including names,
addresses, phone numbers, insurance information and driver's license
numbers on the supplied accident report form will be required upon return
of the vehicle. |

All documents relating to the accident must include a police report
number. |
 |
Insurance coverage may be void if the above instructions are not followed.

CONDITION AND RETURN OF VEHICLE:
You must return the Vehicle to our rental office or other location
we specify, on the date and time specified in this Agreement, and in the
same condition that you received it, except for ordinary wear. If the
Vehicle is returned after closing hours, you remain responsible for the
safety of and any damage to, the Vehicle until we inspect it upon our next
opening for business.
PARKING/TRAFFIC VIOLATIONS:
Renter is responsible to report and pay for all parking/traffic violations
at Vehicle drop-off and return. Failing to report these
violations at Vehicle drop-off and return will cause a charge
of an administrative fee of up to $100.00 plus the fine (including all late
charges) to the customer's credit card.
YOUR PROPERTY:
You release us, our agents and employees from all claims for loss
of, or damage to, your personal property or that of any other person, that
we received, handled or stored, or that was left or carried in or on the
Vehicle or in any service vehicle or in our offices, whether or not the loss
or damage was caused by our negligence or was otherwise our responsibility.
PROHIBITED USES:
The following uses of the Vehicle are prohibited and constitute a
breach of this Agreement. You agree that the Vehicle will not be used: a)
by anyone who is not an Authorized Driver, by anyone not licensed to drive,
by anyone whose driving license is suspended, or by anyone whose driving
license is restricted because of past traffic law violations; b) by anyone
under the influence of alcohol, prescription or non-prescription drugs; c)
by anyone who obtained the Vehicle, or extended the usage or rental period
by giving Us false, fraudulent or misleading information; d) in furtherance
of any illegal purpose, or under any circumstances that could be properly
charged as a crime other than minor traffic violations; e) to carry persons
or property for hire; f) to push or tow anything; g) in any race or speed
contest; h) to teach anyone to drive; i) outside the United States; j) on
any unpaved surface; k) to transport more persons than the Vehicle has seat
belts; l) to transport children without a federally-approved child safety
restraint or booster seat as required by state law; m) when the odometer has
been tampered with or disconnected; n) when the Vehicle’s fluid levels are
low, or it is otherwise reasonable to expect You to know that further
operation of the Vehicle would damage it; o) where applicable, by anyone who
lacks experience driving a vehicle equipped with manual transmission; p) to
transport an animal; q) to commit a willful, wanton or reckless act with the
Vehicle.

Traveling into Death Valley is not permitted between June 1st and

Traveling to New York City, or Apache Trail, Arizona is not permitted |

Using the coach for the Burning Man event near Reno is not permitted |
 |
Traveling is not allowed on beaches, private roads, gravel roads, dirt
roads, logging roads and other non-public roads |
BREACH OF AGREEMENT:
The acts listed in above, are breaches of this Agreement. If you breach
this Agreement, you are liable for all damage to third persons, and all
damage to, or loss of, the Vehicle caused by your breach. Allowing a person
who is not an Authorized Driver to use the Vehicle is a willful, wanton and
reckless act and is a breach of this agreement. You waive all recourse
against us for any criminal reports or prosecutions that we take against you
that arise out of your breach of this Agreement.
MODIFICATIONS:
No term of this Agreement can
be waived or modified except by a writing that we have signed. If you wish
to extend the rental period, you must return the Vehicle to our rental
office for inspection and written amendment by us of the due-in date. This
Agreement constitutes the entire agreement between you and us concerning
this rental. All prior representations and agreements between you and us
regarding this rental are merged into this Agreement.
MISCELLANEOUS:
No waiver by us of any breach
of this Agreement constitutes a waiver of any additional breach or waiver of
the performance of your obligations under this Agreement. Our acceptance of
payment from you or our failure, refusal or neglect to exercise any of our
rights under this Agreement does not constitute a waiver of any other
provision of this Agreement. Unless prohibited by law, you release us from
any liability for consequential, special or punitive damages in connection
with this rental or the reservation of a vehicle. If the Vehicle is
inoperable for more than 24 hours, our liability to you is limited to the
daily rental rate times the number of days the Vehicle is inoperable. If any
provision of this Agreement is deemed void or unenforceable, the remaining
provisions are valid and enforceable.
Safety Unlimited, Inc. will
hold the customer fully responsible for accidents or mechanical breakdowns
occurring in a travel restricted area! |
